Ukrainian Naftogaz sued European Commission for support of Gazprom

The oil and gas company demands to cancel the decision that allowed the Gazprom to increase the flow of fuel through the Opal gas pipeline. 

The Naftogaz appealed to the European Court of Justice with a lawsuit against the European commissioners. The dispute was caused by the EC decision of October 28, 2016, which allowed Gazprom to significantly increase the use of the Opal gas pipeline capacity and the volume of gas pumping through the Nord Stream pipeline, the Ukrainian company said in a press release. 

The Naftogaz believes that in the case of the Gazprom, the European Commission acted «outside» its powers, and therefore its decision is allegedly illegal. 

‘The European Commission violated Article 274 of the Association Agreement between Ukraine and the EU, as well as the EU obligations under the agreement to the energy charter and the agreement on the establishment of the energy community,’ stated the representatives of the Ukrainian company. 

In addition, the representatives of the Naftogaz believe that the decision of the European commissioners contradicts the EU Directive 2009/73 and does not contribute to increasing competition, strengthening the Gazprom dominance.
